The Offshore Partner Visa (Subclass 309/100) allows the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen (ENZC) to join their partner in Australia and live there permanently. The visa process is a two-stage application, where the Subclass 309 is the temporary visa, and the Subclass 100 is the permanent visa.

Eligibility Criteria:

To apply for the Subclass 309/100 visa, you must meet the following:

  • Sponsorship: You must be sponsored by your Australian citizen, permanent resident, or eligible New Zealand citizen partner.

  • Genuine Relationship: You need to prove that you are in a genuine, ongoing relationship, either as a married couple or de facto partners.

  • Health & Character Requirements: You and any dependent applicants must meet Australia’s health and character requirements.

  • Evidence of Relationship: Submit supporting documentation to show the depth of your relationship, including financial, social, and household aspects.

 

Application Process:

  1. Subclass 309 Visa (Provisional): This is the first stage, allowing you to remain in Australia while waiting for the permanent visa to be processed.

  2. Subclass 100 Visa (Migrant): While both applications are submitted at the same time, the Subclass 100 visa is typically processed after the Subclass 309 visa is granted. You’ll need to demonstrate that your relationship is genuine, ongoing, and continues to meet requirements at the time of assessment.

In some cases, the two-year waiting period for the Subclass 100 visa may be waived, especially if you have been in a long-term relationship or have dependent children.
