Partner Visa (Subclass 820/801)

A Partner Visa (Subclass 820/801) allows the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. This visa is granted in two stages: a temporary visa (Subclass 820) and a permanent visa (Subclass 801).

  • Meet health and character requirements.

  • Submit evidence of your relationship, including financial, social, and household aspects, as well as proof of mutual commitment.

 

Application Process

  1. Temporary Partner Visa (Subclass 820): This visa allows you to stay in Australia while your application for the permanent visa is processed.

  2. Permanent Partner Visa (Subclass 801): When applying for a partner visa, you lodge both the Subclass 820 (Temporary Partner Visa) and Subclass 801 (Permanent Partner Visa) applications at the same time. However, in most cases, the Subclass 801 visa is only processed after the Subclass 820 visa is granted.

To be eligible for the Subclass 801 visa, you must demonstrate that your relationship with your partner is genuine, ongoing, and meets all requirements at the time of assessment. This may include providing updated evidence of your relationship to support your case.

In some cases, the two-year waiting period may be waived if you have been in a long-term relationship or have dependent children.
